Calculation of Temporary Partial Disability (TPD) Payments
The calculation of TPD benefits is two-thirds of the difference between the employee’s AWW before the injury and the income they are making from the part-time work the employer is providing after the injury. All of these must be considered to calculate a worker’s Average Weekly Wage (AWW).
Below is the method required to calculate an injured worker’s TPD benefit payments.
- Calculate Workers’ Average Weekly Wage (AWW) from the past 52 weeks.
- Calculate how much you are earning with part-time work.
- Subtract the money currently earned from the AWW.
- The TPD benefit pays two-thirds (2/3) of the difference between your AWW the current wage provided for part-time work.
- In Arkansas, the maximum TPD benefit would never exceed the maximum 2024 TTD benefit rate of $876.00 per week.
When Temporary Partial Disability (TPD) Benefits Start
Benefits begin after a doctor determines it is medically safe for you to return to a part-time and possibly lower paying job based. Benefit payments start after your first week back to work.
Length of Temporary Partial Disability (TPD) Benefit Payments
How long you will receive TPD benefits depends on many factors including medical treatment, medical restrictions, and your employer’s willingness to work with your restrictions.
Immediately call my office if at any time your Temporary Partial Disability (TPD) benefits stop before the end of your healing period, or you have fully recovered from your injuries and your employer refuses to return you to the position or wage you were in prior to your injury, or your employer asks you to resign or quit your job.
